| Uninsured Motorist
When the driver at fault in an motor vehicle accident does not have insurance you may still have a claim. Your own car insurance may have "UM" Uninsured Motorist coverage. You should never waive this coverage, because it protects you if the at fault driver does not have insurance. Your own insurance may have to pay for all damages that the other driver would have had to pay such as pain and suffering, medical expenses, wage loss and other damages. Underinsured Motorist
In this claim we ask for damages over and above what the other drivers liability insurance has to pay. They tend to apply to the more serious injury cases, but also may apply if the medical expenses used up most of the liability insurance settlement. So, for example if the at fault driver has a $25,000.00 policy limit and all of that policy is paid and your own car insurance has more coverage say $50,000.00, then you can bring a case against your own policy for "underinsured motorist".
