Ski Accidents

There are five types of common ski accident cases. A key question for each ski case is whether the injury or death was related to the skiers assumption of risk. The facts of the accident will need to be analyzed in relation to the applicable state law.

Ski Claims - Five Common Types

Collision Claims occur when skiers collide and one skier is at fault and the other brings a claim against the out of control skier typically under a home owners insurance policy .

Fall Claims occur when skiers have an accident while on the mountain and the fault of the crash is due to an improperly designed, maintained, marked or groomed slope. The ski resort may have liability for these cases.

Instructor Claims occur when a skier, under the supervision of an instructor, is taken into unmanageable terrain and injures himself, or when a skier, under the supervision of an instructor, injures a third party and that injury is a result of inadequate supervision or instruction. The ski resort may have liability for these claims.

Equipment Claims occur when injury is caused by a skier's equipment - typically alpine release bindings. The rental business may have liability for these cases.

Lift Claims occur when a skier is injured as a result of a faulty, defective, or improperly maintained lift. The ski resort or manufacurer may have liability for these claims.
